This page gives you information about BM Custom Furniture trading as bmcustomfurniture.ie, bmcustomfurniture.com, customfurnitureireland.com, customfurnituredublin.ie, radiatorcoversdublin.com, radiatorcoversdublin.ie, tvunits.ie, a company registered in Ireland (“we”, “us” and “our”) and the terms and conditions (“Terms”) upon which we sell the products (“Products”) listed on https://www.bmcustomfurniture.ie/ (the “Website”) to you. By ordering any of our Products, you agree to be bound by these Terms and the other documents expressly referred to in it. Therefore, please read these Terms carefully and make sure that you understand them, before ordering any Products from our Website or by phone. You should print a copy of these Terms for future reference. We may change these Terms from time to time. Any such changes will take effect when posted on the Website and it is your responsibility to read these Terms on each occasion you order Products from us. Your continued use of the Website shall signify your acceptance to be bound by the Terms.

We recommend you carefully consider the placement of your furniture before ordering. Think of sockets, valves or pipes near the proposed location for your furniture, or any doors or windows opening towards it. We do not offer electricity & plumbing work. This must be organized by the customer prior to fitting.

Our furniture is custom made based on your measurements, your design and on your request. For most furniture, we will visit and confirm the measurements ourselves. There are no refunds and no replacements if you have a change of heart regarding dimensions or design after placing your order. We can not re-sell the furniture, or reuse the materials. We are also not able to modify or change measurements if you end up not having room for the product, or try to move it.

You may be entitled to a repair in the event of a manufacturing defect. You should report any defect upon delivery and fitting. Payment confirms you have accepted the furniture to be in an undamaged state and conforms to the design agreed. Risk for the Products will pass to you upon the completion of delivery and ownership over the Products shall pass to you once we have received payment in full.

Wear and tear is not a manufacturing defect, neither are domestic accidents. Of course, if your furniture gets damaged due to a domestic accident, and you are happy to compensate us, then we can quote and provide a replacement. Repairs or alterations on location, however, are often not possible due to the need for tools, machines and re-painting.

Purchase refunds are only given in the event you cancel your order before production has started. Once we bought and altered the materials, a refund is no longer possible, as we won't be able to reuse them.

Also please note we are not an online shop. We offer the service to make bespoke furniture upon your request. In return you will compensate us for the materials and services provided. We do not practise online, distance or door-to-door selling. Therefore a 14 day cooling off period does NOT apply to our services and products.

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by any act or event beyond our reasonable control, including without limitation, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, sickness of staff, storm, flood, earthquake, subsidence, epidemic or other natural disaster.

To our discretion, and only if due to our own fault, we can offer a full refund if delivery is delayed beyond reasonability. Once a refund is offered this will clear us from any further obligations towards you.

Any agreement is between you and us. No other person shall have any rights to enforce any of its terms under the Contracts (Rights of Third Parties Act) 1999.

If any provision of the Contract is held invalid, illegal or unenforceable by any court of competent jurisdiction, such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if the Agreement had been executed with the invalid, illegal or unenforceable provision eliminated.

Any failure or delay by us in enforcing or partially enforcing any of our rights or remedies under the Agreement will not be construed as a waiver of any of our rights under the Agreement and shall not prevent us from later asserting such rights.

The formation, existence, construction, performance, validity and all aspects of the Agreement shall be governed by and construed in accordance with the laws of Ireland and we each agree to submit to the exclusive jurisdiction of the Irish courts in all matters relating to the Contract (whether contractual or otherwise).

Frequently asked questions (FAQ)

50% of the total quoted price needs to be paid to secure and place the order. The remaining balance will need to be paid on delivery. If you can not present payment on delivery then we reserve the right to not deliver, or if already installed, reclaim the furniture.

Unless you made a specific commitment to pay in a certain way, payment can be made cash, by card ( we accept all debit & credit cards, Apple-Pay and G-Pay) or by IBAN bank transfer. PLEASE NOTE: If you wish to pay by bank-transfer, then please do this 1 day before we fit your order, as we will need to verify the payment before delivery.

Regrettably, if goods have been assembled or fitted then the item cannot be returned to us. The product you ordered was made to measure to fit in your home. We won’t be able to reuse the materials or resell it. Therefore we do not allow returns once a delivery has been made.

Our carpenters check your furniture to make sure it’s up to our high standards before we deliver it, so damage is rare. Upon delivery of your goods, you must inspect them for damage. If you believe the goods are damaged, or a manufacturing error made, in any way then you should ask the carpenter to fix it straight away. If you chose to accept delivery and pay the carpenter, then you thereby confirm the product conforms to what you have ordered and is in an undamaged state. If you discover damage in a later stage, then based on our terms and conditions you will no longer be able to return the product and we will not be able to refund against.

Yes, you can cancel your order. Deposit’s made are however not fully refundable. Every product ordered requires a minimum deposit of 50 euro, but usually 50% of the quoted price, or higher depending on the total price. The deposit will need to be paid when the carpenter visits you to take measurements. Only if you pre-paid your order in full, then we can refund up till 50% of the order total. You will not receive a full refund, as we already purchased and altered the needed materials in order to fabricate your furniture.

We will issue the refund straight away, it can take a few working days to hit your account depending on your own bank.
